1. Definitions

1. "Agreement": These Terms of Service (ToS) and incorporated policies.
2. "Service": The software-as-a-service platform provided by BetUnfair (accessible at https://www.betunfair.io), including odds monitoring, analytics, and alerts.
3. "User": Any natural or legal person accessing or using the Service.
4. "Content": Data, algorithms, and analytics generated by the Service.

2. Acceptance of Terms

2.1 By accessing the Service, the User agrees to be bound by this Agreement and confirms:

• They are at least 18 years of age and legally competent to enter binding contracts under Danish law (Aftaleloven § 1).
• They acknowledge sports betting involves financial risk, and BetUnfair does not guarantee profits.

2.2 Violation of these ToS may result in immediate termination of access.

3. Scope of Service

• Real-time odds aggregation and monitoring.
• Value betting alerts based on algorithmic analysis.
• Performance analytics and reporting tools.

3.2 Disclaimer: The Service constitutes informational tools only. BetUnfair is not a gambling operator, bookmaker, or financial advisor. Users are solely responsible for complying with applicable gambling laws, including the Danish Gambling Act (Spilleloven).

4. User Obligations

4.1 The User agrees to:

• Use the Service lawfully and ethically, refraining from fraud, money laundering, or manipulation under Danish Penal Code (Straffeloven) §§ 279-283.
• Not reverse-engineer, scrape, or exploit the Service’s infrastructure or data without prior written consent.
• Maintain accurate registration details and promptly update changes.

5. Subscription & Payments

5.1 Fees: Subscription fees are billed in EUR (inclusive of VAT). Danish VAT (25%) applies to EU consumers per the Danish VAT Act (Momsloven).

5.2 Renewals: Subscriptions auto-renew for successive billing cycles unless terminated.

5.3 Refunds: All fees are non-refundable except as required under the Danish Consumer Contracts Act (Forbrugeraftaleloven § 17).

6. Money-Back Guarantee

6.1 New Users with a paid subscription may request a full refund within 30 days of the initial purchase, if following conditions are met:

• The User has not previously subscribed to BetUnfair.
• The User has supplied sufficient evidence they have not made a profit using the Service.
• The User has not violated these ToS.

7. Free-Trial Offer

7.1 New Users may be eligible for a free trial period of 5 days. The User must provide valid payment information to activate the trial.

7.2 The User must cancel the subscription before the trial ends to avoid being charged. If the User does not cancel, the subscription will auto-renew at the standard rate.

7.3 The User may only use the free trial once. If the User has previously used a free trial, they will not be eligible for another. Creating multiple accounts to exploit the free trial is prohibited and may result in account suspension or termination.

8. Termination

8.1 By BetUnfair: We reserve the right to suspend or terminate accounts for material breaches of this Agreement, including unlawful use or non-payment.

8.2 By User: Users may cancel subscriptions via the billing settings. Cancellation takes effect at the end of the current billing cycle.

9. Intellectual Property

9.1 All rights, titles, and interests in the Service, including algorithms, UI/UX, and Content, remain the exclusive property of BetUnfair or its licensors.

9.2 Users receive a non-exclusive, non-transferable, revocable license to access the Service for personal or internal business use.

10. Limitation of Liability

10.1 No Warranty: The Service is provided "as is" without warranties of merchantability, fitness for purpose, or accuracy.

11. Data Protection (GDPR)

11.1 Processing of personal data complies with Regulation (EU) 2016/679 (GDPR) and the Danish Data Protection Act (Databeskyttelsesloven).

11.2 Users may exercise GDPR rights (access, rectification, erasure) by contacting [email protected]

12. Dispute Resolution & Governing Law

12.1 Applicable Law: This Agreement is governed by Danish law, excluding conflict-of-law principles.

12.2 Mediation: Parties agree to mediate disputes in good faith prior to litigation.

13. Amendments

13.1 BetUnfair reserves the right to modify these ToS. Continued use after updates constitutes acceptance.

13.2 Material changes will be notified ≥30 days in advance via email or in-app notice.

14. Miscellaneous

14.1 Severability: If any provision is deemed invalid, the remainder of the Agreement remains enforceable.
